freshfetch Pet Foods grants you a limited license to access and use the Web
site, including to display and download its content, only for your personal,
non-commercial use and provided that you do not modify the Web site, its
content, or any copyright or other proprietary notices. This license terminates automatically
if you breach any of these terms and conditions of use. Upon termination, you
must immediately destroy all copies in your possession. You must not distribute, physically

food we prepare is appropriate for your pet, you are advised to always check
with your veterinarian prior to changing your pet’s diet, and to seek your
veterinarian’s advice if you have any questions or concerns about the freshfetch
Pet Foods meals before you order.

fullest extent permitted by law, any and all warranties, express or implied,
relating to the Web site or its content, including but not limited to, implied
warranties of merchantability, completeness, timeliness, correctness,

Payment Acceptance
By purchasing goods or services from freshfetch Pet Foods (“We”), through this Web site or by
telephone you understand that We will use generally accepted industry practices
to ensure that your identity is that which you portray to us and that your
payment method is not being used fraudulently.
We will attempt to match the billing address of any electronic payment
method that you request or attempt to use with the shipping address for goods
that you purchase. We will attempt
to match the account address we maintain on file for you with the billing
address of the electronic payment method for services that you purchase. We may, at our sole discretion,
politely decline to ship our products to an address that does not match your
billing address.
By making electronic payment using a credit card or a debit card, you understand and agree that
your use of that payment method with us constitutes a transaction with the same
agreement to pay as would a transaction where you are present and your signature
were applied to that agreement. You
further agree to contact us first in the event that any product you purchase
arrives damaged, spoiled, or otherwise substantially different than it was
represented, and to use freshfetch Pet Foods
Customer Service to correct the
problem.
We will securely maintain information about the payment method that you select, and use that
information to bill you when we send goods to you based upon your requests. These requests constitute an order. We will bill you, using your selected
payment method, only after your order(s) have been shipped. If, in your order, you choose to have
products shipped to you periodically until you cancel, you will need to notify
us by using the Web site or calling freshfetch Pet Foods
Customer Service in order to cancel
your ongoing order. If, in your
order, you choose to have products shipped to you for a specified period of time
(say, for eight weeks or ten weeks, etc.) your billing will stop automatically
after the last of the product in your order has shipped to you. You will receive a notice at the
email address you register with us about 48 hours before we ship goods to you
and bill you using your payment method.
Shipping, Returns
and Replacement
freshfetch Pet Foods will ship your order to you via United Parcel Service.
The food that you order will be packed
in a thermally-insulated package.
The food and its packaging constitute a shipment.
You, or your authorized agent, should be available to accept the shipment
on the day that it is scheduled to arrive at the address to which you tell us to
ship it. You understand that
your shipment will contain fresh food, and that spoilage is probable if the
shipment is left unattended, is not deliverable because no one is available to
accept it, or is not stored properly after delivery. freshfetch Pet Foods has designed
packaging that is intended to ensure that your shipment arrives at a temperature
of 40 degrees (F) or less.
Instructions are included with your shipment about freezing and refrigerating
portions of your shipment after it arrives.
freshfetch Pet Foods cannot be
responsible for spoilage or other damage caused by shipments that are mishandled
after delivery, or that cannot be delivered when delivery is first attempted.
The food that we
ship to you is custom-prepared for your pet.
Your order may not be returned since it cannot be re-sold or used for
another purpose.
freshfetch Pet Foods (“We”) will replace any food that arrives damaged, spoiled, otherwise
substantially different than it was represented, or was not delivered or
attempted to be delivered to the shipping address on record for your account. For instance, We will replace your
order if, by error, we shipped the wrong formula or wrong meal for your pet, and
that meal is not what you ordered.
If the delivery was made to the correct address, we will replace the food
provided that: 1) you or an agent were present to accept the order (and, where
appropriate, to sign the delivery receipt for the order) on the date and at the
time that it was originally presented for delivery; 2) you call or email
freshfetch
Customer Service on the day that
your order was to be delivered to notify us about the damage, spoilage or other
substantial difference between the delivery and its representation to you before
the purchase; 3) you follow all instructions included with the shipment
regarding the immediate storage and maintenance of the food in the delivery.
